Liability Agreement

The purchaser of any product offered by Catwinger LLC agrees to hold Catwinger LLC and its members harmless of any injury, death or damage incurred during use of the product.

The purchaser has been advised that the sport of sailing entails various risks to the sailor, passengers and property. Upon purchase of the product, the buyer is aware that use of the product includes various risks, such as product breakage or physical entanglement and resulting injury. Among these risks are drowning, concussion, lacerations, bone fractures, collisions and many others such that may occur while sailing, assembling or transporting a sailboat.

Catwinger LLC makes no assertions that its product will not break, bend or fail under the physical stresses associated with sailing/transporting. The buyer of the product assumes 100% of ALL RISKS associated with the installation and use of the product.

Should the product fail due to normal use or an error of worksmanship, Catwinger LLC is responsible only to work with the original buyer to arrive at a mutually agreed upon refund or repair.

If the buyer is not comfortable assuming ALL RISKS, then Catwinger LLC and its members strongly advise AGAINST purchase of the product.
